These Terms of Service ("Terms") govern your access to and use of ReelPilot Inc.'s platform, including our website, web application, connected device services, and APIs (collectively, the "Service"). Please read these Terms carefully before using ReelPilot.
Acceptance of Terms
By accessing or using ReelPilot, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use ReelPilot. These terms apply to all visitors, users, and customers of the platform.
Use of the Service
ReelPilot is a platform for recording, processing, and publishing short-form video content for healthcare and wellness clinics. You may only use ReelPilot for lawful purposes and in accordance with these Terms. You agree not to use ReelPilot to upload, store, or publish content that is unlawful, harassing, defamatory, obscene, or that infringes intellectual property rights.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account due to your failure to maintain credential security.
Content Ownership
You retain all rights to the video content recorded through ReelPilot devices and generated clips. By using our platform, you grant ReelPilot a limited license to process, store, and transmit your content solely to provide the service. You represent that you have all necessary rights and consents from individuals appearing in recorded content, including patient or client consent as required by applicable law.
HIPAA and Healthcare Compliance
ReelPilot is not a HIPAA-covered service. Video recordings and clips may be subject to HIPAA if they constitute Protected Health Information (PHI). You are solely responsible for ensuring your use of ReelPilot complies with HIPAA, state privacy laws, and any other applicable regulations. If your use case may involve PHI, you must obtain appropriate patient consent and implement necessary safeguards before using ReelPilot to record treatment sessions.
Payment and Subscriptions
ReelPilot subscriptions are billed monthly or annually in advance. Credits purchased separately do not expire but are non-refundable. Subscription fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Continued use after price changes constitutes acceptance.
Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for damages resulting from service interruptions, outages, or data loss, except as limited by applicable law.
Termination
Either party may terminate the agreement at any time. Upon termination, your access to ReelPilot will cease and your data will be deleted within 90 days per our retention policy. We may terminate your account immediately if you violate these Terms. Outstanding amounts remain due upon termination.
Limitation of Liability
To the maximum extent permitted by law, ReelPilot's liability for any claim arising from these Terms or your use of the service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California. You waive any right to a jury trial for disputes arising from these Terms.
